Terms of Service

By accessing, downloading, installing, or using PwrQR, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes indicates your acceptance of the new Terms.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install PwrQR on your personal device(s).
• Use the Service for personal, non-commercial purposes.
• Create, save, and share QR codes generated through the Service.

This license does not include the right to modify, reverse engineer, decompile, or create derivative works of the Service.

You agree not to use the Service to:

• Create QR codes containing illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content.
• Distribute malware, viruses, or other harmful code.
• Infringe upon intellectual property rights of others.
• Engage in phishing, fraud, or deceptive practices.
• Violate any applicable local, state, national, or international law.

We reserve the right to terminate your access if we believe you are violating these terms.

The Service, including its original content, features, and functionality, is owned by PwrQR LLC and is protected by international copyright, trademark, and other intellectual property laws.

• Your Content: You retain all rights to the content you use to generate QR codes.
• Generated QR Codes: QR codes you create are yours to use freely.
• Our Branding: You may not use our trademarks, logos, or branding without prior written consent.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF QR CODE GENERATION

We do not warrant that the Service will be uninterrupted, secure, or error-free. Use of the Service is at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PWRQR LLC SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, use, goodwill, or other intangible losses.
• Any damages resulting from unauthorized access to or use of your device.
• Any damages arising from QR codes created using the Service.

Our total liability shall not exceed the amount you paid for the Service (which is zero for free users).

You agree to indemnify, defend, and hold harmless PwrQR LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service.
• Content in QR codes you create.
• Your violation of these Terms.
• Your violation of any third-party rights.

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination:
• Your license to use the Service ceases immediately.
• Local data on your device remains under your control.
• Provisions that by their nature should survive termination shall survive.

These Terms shall be governed by the laws of the State of Wyoming, United States, without regard to conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through:

1. Good faith negotiation between the parties.
2. Binding arbitration in accordance with AAA rules.
3. Courts located in Wyoming for injunctive relief.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
